This Privacy Policy sets forth the principles used by SoundUniq to collect, process and use of personal

data on the App.

This Privacy Policy is an integral part of the Terms of Service. All capitalised terms contained herein

but not defined shall have the meaning set forth in the Terms of Service.

SoundUniq complies with the applicable data protection provisions pursuant to which every person is

entitled to protection of their privacy and to protection against misuse of their personal data. Personal

data will be kept strictly confidential and will not be sold or passed on to third parties (other than as set

out in this Privacy Policy).

In general, the App can be visited without providing any personal data. If, however, any data is

provided during the visit on or the use of the App, SoundUniq safeguards the protection of your

personal data during its collection, processing and use while visiting and/or using the App. SoundUniq

is not liable for any external links to third-party content.

1. COLLECTION AND STORAGE OF PERSONAL DATA AND PURPOSE OF THEIR USE

a) During the visit on the Website, the internet browser used on your device automatically sends

information to the server of the Website. This information is temporarily stored in a so-called logfile

(log file) on the server side (web hosting provider). The following data will be collected without the

User’s intervention and stored until automated deletion:

● if necessary, IP address of the requesting computer, as well as device ID or individual device

identifier and device type,

● name of the retrieved file and amount of data transferred, as well as date and time of retrieval,

● Message about successful call,

● requesting domain (origin of your request, from which you came to the Website,

● Description of the type of internet browser used and, if applicable, the operating system of

your terminal and the name of your access provider,

● Location information, including location data from your mobile device. Please note that on

most mobile devices, you can control or disable the use of location services in the mobile

device's settings menu.

The collected and stored data can be used for the following purposes:

● Ensuring a smooth connection setup and comfortable use of the Website,

● Evaluation of system security and stability, and

● for further administrative purposes.

In no case we use the collected data for the purpose of drawing conclusions about the visitors.

b) When creating a User Account and subscribing for a subscription plan on the App:

● Data that personally identifies the User (name, address, e-mail address),

● Financial information

● Communications data

● other personal data required for the User’s authentication, identification or verification of the

data collected.

The collected and stored data will be processed for the following purposes:

● Conclusion and performance of the contractual relationship

● Improvements of the Website and the App (including content), in particular to enhance the

user experience

● Statistical analysis of the use of the Website and App

● Marketing purposes,

● Assertion of claims or defence against claims in legal proceedings, or

● for further administrative purposes.

2. TRANSFER OF PERSONAL DATA

In connection with the performance of the contractual obligations, for any prevailing interest of

SoundUniq or for the purposes set out in section 1 above, we may transfer your personal data to third

parties (in and outside of Switzerland).

3. RIGHTS OF THE VISITOR / USER

Upon request from a visitor or a User, SoundUniq will inform them whether and which personal data

about such visitor or user are stored. The visitor/User has further the right to correct any incorrectly

collected personal data or to complete incomplete data collected. Furthermore, the personal data will

be automatically deleted by SoundUniq if the purpose of the data collection has been omitted or the

data processing has been unlawful.

EACH VISITOR/USER HAS THE RIGHT TO REVOKE ANY CONSENT GIVEN AT ANY TIME.

SOUNDUNIQ WILL, AS A RESULT, CEASE THE DATA PROCESSING BASED ON SUCH

CONSENT.

To exercise the right of revocation or objection, it is sufficient to send an email to the e-mail address

listed at the end of this Privacy Policy.

4. DURATION OF DATA STORAGE

All data collected will be stored as long as required for the performance of the agreements entered into

between SoundUniq and the User, for any other processing purposes (such as dispute resolution or

enforcement of our principles), for technical reasons or due to SoundUniq’s prevailing interests. Where

SoundUniq is obliged by mandatory law to store data, such data will be deleted after the applicable

retention period expires.

5. EXTERNAL APPLICATIONS AS INTEGRATION IN OUR APP

Google ID

The App uses Google ID to authenticate the User when an individual account is created. Google ID

provides the relevant personal information to SoundUniq and SoundUniq stores the data in

accordance with this Privacy Policy. The use and processing of personal data by Google ID are set

forth in the terms of use and the privacy policy of Google ID ( Google ID Terms of Use ).

Apple ID:

The App uses Apple ID to authenticate the User when an individual account is created. Apple ID

provides the relevant personal information to SoundUniq and SoundUniq stores the data in

accordance with this Privacy Policy. The use and processing of personal data by Google ID are set

forth in the terms of use and the privacy policy of Apple ID ( Legal - Apple ID & Privacy - Apple ).

In-App Purchases (Google and Apple):

The App uses In-App Purchases (Google and Apple) for the purpose of processing the financial

transactions on the App. The payments are exclusively processed by In-App Purchases (Google and

Apple) with encryption whereas SoundUniq receives solely a confirmation of the payments.

SoundUniq does not store any transaction information other than those confirmations. The use and

processing of personal data by In-App Purchases (Google and Apple) are set forth in the terms of

use and the privacy policy of Stripe (Apple: https://www.apple.com/legal/privacy/data/en/app-store/ )

and (Google: https://policies.google.com/privacy ).

6. DATA SECURITY

SoundUniq takes all necessary technical and organisational security measures to store personal data

safe from access from third parties or the public. Any confidential information shall be shared with

SoundUniq via telephone, post, encrypted email or contact form.

7. EFFECTIVE DATE AND AMENDMENTS

This Privacy Policy is effective as of 23.03.2024.

Due to the further development of the App and SoundUniq’s services and offers or due to changed

legal or regulatory requirements, it may be necessary to change this Privacy Policy. SoundUniq may

change this Privacy Policy at any time without prior notification.
